U.S. District Judge James Boasberg has ordered the Trump administration to facilitate hearings for Venezuelans deported to El Salvador this year.
In an opinion on Dec. 22, Boasberg said the administration violated due process when it removed individuals under the Alien Enemies Act. As part of his decision, he directed the administration to provide details on how they intended to facilitate the return of the deported individuals to the United States.
“The Government could also theoretically offer Plaintiffs a hearing without returning them to the United States so long as such hearing satisfied the requirements of due process,” he added.
Boasberg’s decision follows months of litigation and the administration’s initial deportations under the Alien Enemies Act in March. Those individuals were taken to El Salvador and detained at CECOT, a notorious prison for gang members….
