A federal appeals court ruled Tuesday that President Donald Trump had unlawfully invoked the Alien Enemies Act to deport Venezuelan illegal immigrants who were suspected of being part of a criminal gang.
In a 2-1 decision, the 5th U.S. Circuit Court of Appeals barred the Trump administration from carrying out deportations under the wartime law in Texas, Louisiana, and Mississippi.
Trump signed a proclamation invoking the Alien Enemies Act on March 15, stating that many members of the Tren de Aragua gang have “unlawfully infiltrated the United States and are conducting irregular warfare and undertaking hostile actions” against the country.
