Ontario’s recently implemented mandatory cash bail rules will be temporarily suspended while a Superior Court justice examines their compatibility with Canada’s constitution.
Justice William Chalmers granted the injunction sought by the Canadian Civil Liberties Association and the Criminal Lawyers’ Association after their legal teams and the province’s lawyers presented arguments in the case last week.
The new regulations came into effect on Aug. 17, stipulating that those accused of a crime and granted bail are required to provide a cash security deposit within two business days following their release.
Individuals charged were previously obligated to make the payment only if the conditions for release were violated and the court ordered the payment….
